Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Social Thirst AI website and application (collectively, the "Service"), operated by Social Thirst AI B.V. ("SocialThirst," "we," "us," or "our"), a company registered in the Netherlands.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Description of the Service

Social Thirst AI provides a content strategy and analytics suite for TikTok and Instagram, designed for brands and marketing agencies. The Service includes cross-platform analytics, performance alerts, trend and competitor intelligence, AI-assisted content tools, and related features. We may add, modify, or remove features at any time.

2. Eligibility and Accounts

To use the Service you must be at least 18 years old and capable of forming a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account.

3. Connecting Third-Party Accounts

The Service allows you to connect third-party platform accounts, including TikTok and Instagram, through their official authorization flows (OAuth). When you connect an account:

  • You authorize Social Thirst AI to access and process data from that platform on your behalf, limited to the permissions (scopes) you grant.
  • You may revoke this access at any time, either within the Service or directly in the settings of the relevant platform (for TikTok, via your TikTok account's app management settings).
  • Your use of each connected platform remains subject to that platform's own terms of service and policies, including the TikTok Terms of Service and the TikTok Developer Terms. You are responsible for ensuring you have the right to connect any account you connect.

We access third-party data solely to provide the Service to you and in accordance with our Privacy Policy and the requirements of the relevant platform.

4. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or third-party platform policy;
  • Attempt to access data or accounts you are not authorized to access;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Use the Service to collect, store, or process data about individuals without a lawful basis;
  • Resell or redistribute the Service without our written consent.

5. Subscriptions and Payment

Certain features require a paid subscription. Pricing, billing cycles, and plan details are presented at the point of purchase. Fees are payable in advance and, except where required by law, are non-refundable. We may change pricing with reasonable advance notice. Failure to pay may result in suspension or termination of access.

6. Intellectual Property

The Service, including its software, design, and content (excluding your data and third-party platform data), is owned by Social Thirst AI and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription. You retain all rights to the data you provide or connect.

7. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. We process data connected from third-party platforms only to deliver the Service to you and in line with the policies of the relevant platform.

8. AI-Generated Content

The Service includes AI-assisted features that generate suggestions, insights, and content. Such output may be inaccurate or incomplete. You are responsible for reviewing and verifying any AI-generated output before relying on or publishing it. Social Thirst AI makes no warranty as to the accuracy or suitability of AI-generated output.

9. Service Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may suspend or limit the Service for maintenance, updates, or reasons beyond our control. Analytics and metrics provided through third-party platforms depend on those platforms and may be delayed, incomplete, or unavailable.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Social Thirst AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law or by a third-party platform. Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, except where mandatory consumer protection law provides otherwise.
